What is Diversion?

The DUII Diversion Program is a legal agreement with the Court that sets aside a guilty or no contest plea and enables the case to be dismissed in one year if all the terms of the Diversion agreement are satisfied.

What are the terms of the agreement?

  1. Attend Diversion orientation on Monday at 3:00 p.m. at the Community Corrections Annex;
  2. Complete an alcohol screening (statutory requirement) in the county that you were placed on diversion in. You will be scheduled for your screening at the end of the diversion orientation. There is a statutory fee of $150.00 that must be paid at the time of your appointment. You will not be seen if the fee is not paid. If you reschedule or miss your evaluation you will be charged a $20.00 fee.
  3. At the alcohol screening you will be referred to a treatment program. All clients placed on diversion are required to enter and complete the appropriate level of treatment.
  4. Attend Victims Panel. The Court will give you a date to attend the next Victims Panel. The fee is $20.00 payable at the door. Check-in begins at 7:00 p.m. and the panel begins promptly at 7:30 p.m... NO late entries are allowed.
  5. Pay all of your court fines and fees in full. Prior to leaving the Court it is in your best interest to set up a payment plan. 100% of fees must be paid in full prior to your diversion end date.
  6. If you are a Circuit Court case you must file a motion to dismiss within the last 30 days of your diversion. Click on this link to print a form. McMinnville Municipal Court cases do not need to submit a motion to dismiss.

    What will happen if I don’t complete all of the terms of the diversion agreement within the one year timeframe?

    The Court allows one year to complete ALL of the diversion requirements. Time is of the essence which will require you to start the process immediately. If you are approaching the one year mark and all of your conditions are not complete you can request an extension. Extensions can be granted ONE TIME for up to 180 days.

    How do I get an extension?

  7. If your Diversion is through Yamhill Co. Circuit Court, you are required to file the extension within the last 30 days of your diversion period. Click on this link and fill out the form completely and return it to the Court. A hearing will be set to review your request.

    If your Diversion is through McMinnville Municipal Court contact Evaluation Services NW and request an extension in the last 30 days of your diversion period.
